All legal and natural persons (excluding minors, defined as natural persons under 18 years of age as of July 23, 2019) who were residents of Canada (including without limitation any of its provinces and territories) during the Class Period and who purchased and/or used or consumed one or more Red Bull CEDs in Canada during the Class Period, excluding Released Parties.
All consumers in Canada who have received textured surface breast implants manufactured, marketed or sold by Allergan Inc., Inamed Corporation, Mentor Worldwide LLC or Ideal Implant Inc.
Every consumer, pursuant to the terms of Quebecâs Consumer Protection Act, who, since June 1st, 2015, purchased a beverage from the Bar Valet de Carreau, Bar Dame de Coeur, Bar Roi de pique and/or the Bar Poker, all situated in the Casino de MontrĂ©al, and who would have been charged, between 12:00 a.m. and 3:00 a.m., on nights from Saturday to Sunday, a higher price than that advertised on the menu.
All persons, entities, partnerships or organizations resident or domiciled in Quebec, who, since May 31st, 2015, had a hypothecary loan and/or a collateral hypothec with any of the Defendants and who paid a mortgage prepayment charge in an amount that exceeds three months of interest as a result of paying off their mortgage early;
Consumers residing in Quebec who purchased on the primary market at least one (1) ticket to an event in the Province of Quebec using either: a mobile phone or other mobile device via either www.ticketmaster.ca or one of the Ticketmaster mobile applications, between June 23, 2013 and May 24, 2017, or with respect to certain Quebec Venues, the www.ticketmaster.ca website with the use of a desktop computer or standard internet browser, between September 30, 2015 and May 24, 2017.
Every consumer, pursuant to the terms of Quebecâs Consumer Protection Act (âCPAâ), residing in Quebec at the time of purchase, who since August 28th, 2012 (the âClass Periodâ), while physically located in Quebec, has purchased from any of the Respondents at least one âTicketâ (as defined in section 236.1 CPA as meaning any document or instrument that upon presentation gives the ticket holder a right of entry to a show, sporting event, cultural event, exhibition or any other kind of entertainment) either: (a) at a price above that announced by the vendor authorized to sell the Tickets by the producer of the event; and/or, (b) who paid a price higher than the price advertised by Respondents on their respective websites and/or mobile applications (at the first step), excluding the Quebec sales tax or the Goods and Services Tax; or any other group to be determined by the Court;
All consumers who, between December 20, 2015 and January 26, 2023, purchased AppleCare and/or AppleCare+ for an Apple product in Quebec, including but not limited to an iPhone, Apple Watch, iPad, iPod, Mac and/or MacBook and were not informed of their legal warranty under the Consumer Protection Act at the time of purchase.
Class: Every consumer, pursuant to the terms of Quebecâs Consumer Protection Act (âCPAâ), who since July 4th, 2013 (the âClass Periodâ), was provided services or goods at a reduced price (the âReduced Priceâ), for a fixed period (the âFixed Periodâ), by any of the Defendants, and who, after the Fixed Period, was required to send a notice to any of the Defendants indicating that he/she does not wish to obtain the services or goods at the regular price (the âRegular Priceâ); Sub-class: Every consumer, pursuant to the terms of Quebecâs Consumer Protection Act (âCPAâ), who since July 4th, 2013 (the âClass Periodâ), was provided services or goods free of charge, for a fixed period (the âFixed Periodâ), by any of the Defendants, and who, after the Fixed Period, was required to send a notice to any of the Defendants indicating that he/she does not wish to obtain the services or goods at the regular price (the âRegular Priceâ);
Every consumer, pursuant to the terms of Quebecâs Consumer Protection Act, who since July 4th, 2013, was provided services by Spotify Canada Inc. at a reduced price or free of charge, for a fixed period, and who, after the fixed period, was required to send a notice to Spotify Canada Inc. indicating that he/she does not wish to obtain the services at the regular price;
Every consumer, pursuant to the terms of Quebecâs Consumer Protection Act, who since July 4th, 2013, was provided services by Audible Inc. through an Eligible Account at a reduced price or free of charge, for a fixed period, and who, after the fixed period, was required to send a notice to Audible Inc. indicating that he/she does not wish to obtain the services at the regular price; Eligible Account means an Audible.com account that meets the following cumulative criteria: a) was opened by a natural person physically residing in the province of QuĂ©bec during the Class Period further to signing up for a 30-day trial on Audible.com while continuing to physically reside within the province of QuĂ©bec; and b) has actually paid membership fees as a result of maintaining their membership for at least thirty (30) days after the date of signing up (the âputative settlement class membersâ);
