What this class action was about:
The Plaintiffs alleged that, following planned maintenance to some of its systems in November 2024, Scotiabank’s customers had intermittent access to accounts which partially affected their ability to make transactions such as e-transfers and bill payments. Scotiabank denies any wrongdoing or liability in this matter. The parties have reached a settlement, a copy of which is accessible below.
Class:
All consumers and businesses in Quebec with an account at Scotiabank (including credit card or line of credit) who could not use one or more of their Scotiabank services from November 8, 2024, and until the Scotiabank services were fully restored.
Terms of the Settlement:
Without admission of any kind, Scotiabank will pay a maximum of $215,000 to fully and finally settle this class action. This amount will notably be distributed as follows, subject to Court approval:
- $117,000 in the form of a direct credit of $4.00 for each Class Member that was an active client of the Scotiabank on April 29, 2026, and for whom the Scotiabank has already waived or reversed over-limit fees and credit card interest charges on their credit card accounts; and
- $35,000 in the form of a reparative measure paid to the Legal Clinic of the University of Montreal to support the Summer 2027 Initiative on Financial Fraud Prevention and Legal Support.
Status:
By judgment rendered on October 21, 2026, the Superior Court of Quebec authorized the class action for settlement purposes only and approved the pre-approval notices. The Settlement approval hearing is scheduled for December 8, 2026, at 9:30 a.m., in room 2.08. The TEAMs link will be posted here once available.
