What this class action is about:

Scotiabank claims that it performed a “scheduled maintenance” between November 8 and 12, 2024, that was supposed to only affect certain credit card and line of credit service. However, on November 12 and 13, 2024, Scotiabank customers were unable to access their accounts (for which they pay a monthly service fee) and were unable to perform basic daily banking transactions such as sending an Interac transfer or paying a bill. This class action seeks compensatory and punitive damages for what is now Scotiabank’s third major bank outage in less than 5 months.

Proposed Class:

All consumers and businesses in Canada with an account at Scotiabank (including credit card or line of credit) who could not use one or more of their Scotiabank services from November 8, 2024 and until the Scotiabank services were fully restored.

Remedies sought:

The purpose of this class action is to obtain:

a) compensatory damages and a reduction of the Class Members’ obligations, such as a refund of the monthly service fees bank; and
b) punitive damages of $100 per Class Member.

Status:

This class action was filed in the Superior Court of Quebec, District of Montreal, on November 13, 2024. Currently pending an authorization hearing.
