What this case is about:
Prior to 2021, La Personnelle and Desjardins implemented, advertised and sold the Ajusto program by systematically telling their customers that the rebate earned and obtained after the 100-day (and 1000 km) period was “locked in” would automatically apply year after year. The promise made was: “Enjoy this discount for as long as you have car insurance with us!” In 2024-2025, La Personnelle and Desjardins began unilaterally removing the Ajusto discount previously earned by their clients and forced these clients to permanently install the Ajusto application if they wished to receive a new discount, that would vary each year. Plaintiff alleges that this modification is in breach of the agreement between the parties and also constitutes false advertising.
Classes authorized by the Court:
Quebec Class:
All persons in Quebec who subscribed to the Ajusto program offered by La Personnelle or Desjardins (or any of their subsidiaries or affiliates) for automobile insurance before February 25, 2021, received a rebate thereunder sold and advertised as being “locked in for as long as you have car insurance with us!”, and whose rebate was unilaterally removed as of January 2025, except those who received a similar rebate under the new Ajusto Program.
Ontario Class:
All persons in Ontario who subscribed to the Ajusto program offered by La Personnelle or Desjardins (or any of their subsidiaries or affiliates) for automobile insurance before April 23, 2021, received a rebate thereunder sold and advertised as being “locked in for as long as you have car insurance with us!”, and whose rebate was unilaterally removed as of January 2025, except those who received a similar rebate under the new Ajusto Program.
Remedies sought for consumers:
The purpose of this class action is to ask the Court to force La Personnelle and Desjardins to honour their legal and contractual obligations and apply the Ajusto discounts earned by their clients, each time they renew their automobile insurance polices, as promised. Alternatively, the Plaintiff will ask the Court for a reduction of the Class Members’ obligations equivalent to the Ajusto discount previously earned and applied, as well as punitive damages.

This class action was authorized by judgment rendered by the Superior Court of Quebec on February 19, 2026. A copy of the authorization judgment is available below or by clicking here.
