tenir U-Haul responsable d&rsquo;avoir lou\u00e9 aux membres du groupe ses fourgonnettes et camions cubes (dont le poids nominal brut est inf\u00e9rieur \u00e0 4 500 kg) sans pneus d&rsquo;hiver comme l&rsquo;exige la loi, et de les avoir plac\u00e9s en danger, ainsi que le public, en en violation du <em>Code de la s\u00e9curit\u00e9 routi\u00e8re<\/em>, du <em>Code civil du Qu\u00e9bec<\/em>, de la <em>Loi sur la protection du consommateur<\/em> et de la Charte qu\u00e9b\u00e9coise.<\/p>\n<p>L&rsquo;article 440.1 al. 1 du <em>Code de la s\u00e9curit\u00e9 routi\u00e8re<\/em>, C-24.2, stipule :<\/p>\n<p><strong>\u00ab 440.1<\/strong> Au cours de la p\u00e9riode du 1er d\u00e9cembre au 15 mars, le propri\u00e9taire d\u2019un v\u00e9hicule routier motoris\u00e9 immatricul\u00e9 au Qu\u00e9bec, autre qu\u2019un v\u00e9hicule lourd, un v\u00e9hicule-outil ou une machine agricole, ne peut mettre en circulation ce v\u00e9hicule, \u00e0 moins qu\u2019il ne soit muni de pneus con\u00e7us sp\u00e9cifiquement pour la conduite hivernale selon les normes pr\u00e9vues par r\u00e8glement du gouvernement. <strong>Cette interdiction s\u2019applique \u00e9galement \u00e0 quiconque offre en location au Qu\u00e9bec un tel v\u00e9hicule sans \u00e9gard \u00e0 son lieu d\u2019immatriculation<\/strong>. \u00bb<\/p>\n<\/div><div class=\"fusion-title title fusion-title-4 fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:20px;--awb-margin-left-small:0px;\"><h3 Qu\u00e9bec qui ont lou\u00e9 un v\u00e9hicule de U-Haul dont le poids nominal brut est inf\u00e9rieur \u00e0 4 500 kg et qui n&rsquo;\u00e9tait pas muni de pneus d&rsquo;hiver \u00e0 l&rsquo;une des dates suivantes :<\/p>\n<ul>\n<li>1<sup>er<\/sup> d\u00e9cembre 2024 au 15 mars 2025;<\/li>\n<li>1<sup>er<\/sup> d\u00e9cembre 2023 au 15 mars 2024;<\/li>\n<li>1<sup>er<\/sup> d\u00e9cembre 2022 au 15 mars 2023;<\/li>\n<li>1<sup>er<\/sup> d\u00e9cembre 2021 au 15 mars 2022.<\/li>\n<\/ul>\n<\/div><div class=\"fusion-title title fusion-title-5 fusion-title-text fusion-title-size-three\"
