Invoking the rule against hearsay evidence and claiming that Defendants acted negligently and unlawfully, Applicant seeks reimbursement of over $50 Million paid by Quebecers to the Government as a result of photo radar and red light camera infractions.

Proposed Class

All natural and legal persons who, since the inception of the photo radar and red-light camera systems in the province of Quebec on August 19th, 2009 (the “Class Period”), were issued a statement of offence involving a photo radar and/or a red-light camera in the province of Quebec;

Remedies sought for consumers

  • Compensatory and moral damages;
  • Declaratory judgment declaring that the photo radar and/or red light camera evidence used by the government is inadmissible and illegal;
  • Injunctive relief ordering the government to cease using photo radar and/or red light camera evidence;

    Photo radar is always a government-run racket for profits. Photo radar produces profits above its own high costs only when used in areas where the posted speed limits are arbitrarily and improperly set at least 10 kph and more usually 20 kph below the safest levels, the 85th percentile speeds of free flowing traffic under good conditions. Example: If 85% of the free flowing traffic is at or below 70 kph, then the safest limit to post for the fewest crashes is 70 kph – NOT 60 or 50 kph to produce more photo radar tickets for profits.

    NO one should support photo radar, it is always a racket.
